The explanation on Enforcement Regulation of the Cosmetic Law¡¯s revision on Jan. 12, 2007

Ministry of Health and Welfare (MOHW) and Korea Food and Drug Administration (KFDA) announced that Enforcement Regulation of the Cosmetic Law (hereinafter referred to as ERCL) is revised as of January 12, 2007 to protect children¡¯s death caused by cosmetics, to provide information which consumers need to know, and to reform the regulation reasonably.
Therefore, we (Cosmetic Consulting) would kindly let you know the revised information (ERCL, Revision No. 380) on some important issues as follows;
1. Safety container (safety cap) for children

- Manufacturer and importer must use safety container (safety cap) for protecting children¡¯s death
caused by cosmetics on following products;
1) Nail Enamel Remover and Nail Polish Remover containing Acetone ingredient
2) Baby Oil product containing over 10% of Hydrocarbon complex on each package
and Non-emulsion type liquid product whose movement viscosity is less than 21 Ceti-Stocks (40¡É).
3) Liquid cosmetics containing over 5% of Methylsalicylate on each package.
Therefore, manufacturers and importers must use Safety Container (Safety Cap) for the above mentioned cosmetic products from January 14th, 2007.
If manufacturers or importers violate above articles, they can not import the relevant product for 3 months.
2. The caution of the cosmetics containing AHA ingredients

KFDA has controlled the regulation on the cosmetics containing AHA as KFDA¡¯s bylaws until now. However, MOHW regulated this AHA rule in ERCL from January 12, 2007.
We, importers (and manufacturers) must have indicated AHA caution on Korean label for every cosmetics containing AHA ingredients until now. Therefore, importers (and manufacturers) have received many claims from our consumers because of the cosmetics containing AHA ingredients. However, MOHW is removing the AHA caution from the cosmetics which can be washed away after use, hair cosmetics, and cosmetics with less than 0.5% of AHA ingredient.
This regulation will be enforced since July 12, 2007.
I think that importers (and manufacturers) will welcome this reasonable revision of the regulation on Korean label.
3. Stipulation of penalty for inappropriate indication on container (or packaging)
and inappropriate advertisement on magazine (newspaper and etc.)

- Advertisement which may give false information as pharmaceutical drug
- Advertisement which may present cosmeceutical information on general cosmetics
-Advertisement which may slander on other company or products.
KFDA has given 3 months suspension of advertisement as a penalty for violation of advertisement regulation until now. However, in addition, revised regulation will include 3 months suspension of sales on the product as a penalty.
The revised regulation on advertisement has become more clear and specific compared with vague expressions in the past. The revised regulation states that if importers violate indication on container or packaging (for example : anti-aging claimed on container), they will get 3 months suspension of product sale as a penalty. And if importers violate advertisement on magazine (or newspapers and etc.) they will get 3 months suspension of product advertisement as a penalty.
