According to the EU Cosmetics Directive, 
CI 77891 Titanium Dioxide as a cosmetic colorant is unrestricted. 
Titanium Dioxide has a 25% maximum use restriction as a UV filter. 
This is a totally different regulation than cosmetics. 

There are the separate annexes for titanium dioxide. 
In Annex IV for cosmetic colorants - see #143 
In Annex VI for UV filters - see #27. 
We use titanium dioxide as a colorant in the nailpolish, not as a UV filter.
